Terms of Use

The agreement between you and Aethrio: what you can rely on, what you cannot, and what we each promise.

The short version

This summary is written to be read. The numbered sections below are what actually binds us both.

Aethrio is a reference, not an authority. We are not the park. Rules change, fire bans change same-day, and where our information disagrees with a posted sign or a ranger, they are right and we are wrong.

Check anything that matters before you go. Fire rules, fees, hours and closures come from published sources that go out of date.

What you post stays yours. You give us permission to display it on the site. You can delete it whenever you like.

Gatherings are organized by users, not by us. We do not vet anyone or supervise anything.

If something goes wrong, email hey@aethrio.co first. We would rather fix it than argue about it.

1.The agreement

Aethrio, at aethrio.co and at grillable.app which redirects there, is operated by Val Aristides, an individual doing business as Aethrio. In these terms, "we" and "us" mean the operator, and "you" means you.

By using the site you agree to these terms and to the Privacy Policy, which is part of them. If you do not agree, please do not use the site.

2.Who may use it

  • You must be at least 13 years old.
  • If you are between 13 and 18, you may use Aethrio only with the permission of a parent or guardian, who agrees to these terms on your behalf.
  • Browsing needs no account. Posting a review, a photo, a list or a gathering does.
  • One account per person, and the account is yours alone. Do not impersonate anyone.

3.What Aethrio is, and what it is not

Aethrio is a catalogue of public parks, beaches and recreation areas, compiled from published sources, chiefly each place's own managing authority, together with content posted by other visitors.

We are not a park, a municipality, a state agency or a federal one, and we are not affiliated with, endorsed by, or acting for any place listed here. We do not operate, inspect, maintain or control any of them. Naming a park does not mean the park knows about us.

4.Accuracy, and the checks you still have to make

We take accuracy seriously. We read the managing authority's own page, we date what we record, and we say when a source states nothing rather than guessing. Even so, all of the following are true:

  • Rules change without notice. Fire bans and grilling restrictions in particular can change the same morning in response to wind, drought or a local order.
  • Hours, fees, closures and amenities change seasonally and without warning.
  • Silence is recorded as silence. Where a source states no rule, we show it as unstated. Unstated never means permitted.
  • Some fields are extracted automatically from official pages and can be wrong or out of date.
  • Reviews, ratings, photos and condition reports are posted by other visitors. They are opinions and observations, not verified facts, and we do not check them before they appear.

Confirm anything that matters with the park before you go, and obey posted signage and any instruction from staff or rangers on the day. Where our information and the posted rule disagree, the posted rule governs. Do not rely on Aethrio for a decision involving fire, safety, legality, accessibility or a permit. Weather and fire-alert data comes from third parties and can be delayed, incomplete or wrong.

5.Outdoor risk is yours

Being outdoors carries risk: water, terrain, weather, fire, wildlife and other people. You use this site to plan your own activity, and you accept the risk of that activity. To the fullest extent the law allows, we are not liable for injury, loss or damage arising from a visit to a place listed here, from a gathering arranged through the site, or from anything you decided to do based on information you found here.

6.Your account

  • Sign-in uses a one-time code sent to your email address, so keeping that mailbox secure is what keeps your account secure. Anyone who can read your email can request a code.
  • Tell us at hey@aethrio.co if you think someone has used your account without permission.
  • You are responsible for what happens under your account.

7.Content you post

You keep it

Your reviews, ratings, photos, captions, lists, gatherings and reports remain yours. We claim no ownership of them.

The permission you give us

You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, resize, re-encode, adapt for display, publish and distribute your content on and in connection with Aethrio, including on park pages, in listings and previews, in share cards, and in material promoting the service itself. We use it to run and show the site, not to sell it on as a dataset.

The licence lasts while the content is on the site. When you delete something it ends, except for two ordinary limits: copies may persist in routine backups until those rotate out, and we cannot recall copies other people or search engines already made.

What you are promising when you post

  • That it is yours to post, or that you have permission to post it.
  • That it is accurate as far as you know. A condition report is a factual claim about a real place, and other visitors will act on it.
  • That it does not infringe anyone's copyright, trademark, privacy or other rights.
  • That any identifiable person in a photo has agreed to appear in it, and that where the person is a child you have their parent or guardian's agreement.

8.What you may not do

Do not:

  • Post false or misleading information about a park's condition, rules, hours or fees.
  • Post anything unlawful, harassing, hateful, threatening, defamatory or sexually explicit, or anything that promotes self-harm or violence.
  • Post another person's private information, including a home address, phone number, workplace or vehicle plate.
  • Post spam, advertising, affiliate links, or the same promotional content repeatedly.
  • Impersonate another person, a park, an agency or a business.
  • Infringe copyright or trademark.
  • Create fake gatherings or fake RSVPs.
  • Try to get around access controls, database security rules, rate limits or moderation, or access an account or record that is not yours.
  • Collect the site's data automatically at scale, whether by scraping, crawling beyond ordinary search-engine indexing, or bulk downloading, or use our catalogue to build a competing one, without our written permission.
  • Reverse engineer the service, interfere with it, or place a load on it that degrades it for other people.
  • Use the site for anything unlawful.

9.Moderation

We may hide, remove or decline content, and suspend accounts, at our discretion and without prior notice, when we believe these terms have been broken or the content is harmful. Hidden content is removed from public view for everyone, including the person who posted it.

We have no obligation to monitor content, and moderating some of it does not mean we have reviewed all of it. Content posted by users is theirs, not ours, and we are not responsible for it.

10.Gatherings

A gathering is organized by the person who created it. We do not organize, host, vet, verify, attend or supervise anything. We do not check who the host is, whether the RSVPs are real, or whether the plan is a good one.

  • Anyone with the link can see a gathering and RSVP to it. Treat the link as public.
  • Follow the park's own rules on group size, reservations, permits, alcohol and fires, and get a permit where one is required. Many parks require one for groups.
  • You are responsible for your own safety, your own conduct and, if you are the host, for the arrangements you make.

11.Our content, and the sources behind it

The design, code, written descriptions, and the compiled catalogue of Aethrio belong to us or are licensed to us. Facts about a public park belong to nobody, and we make no claim on them. The particular selection, verification, wording and presentation are ours.

You may link to any page here freely, and quote a short passage with attribution and a link. You may not copy the catalogue in bulk.

Some material comes from others and stays theirs: map data from OpenStreetMap contributors with tiles by CARTO, icons from Phosphor Icons under the MIT licence, forecasts from Open-Meteo and the National Weather Service, and some park photographs from Wikimedia Commons under the licence credited on the page. Their terms apply to that material.

12.Copyright complaints

If you believe something here infringes your copyright, email hey@aethrio.co with:

  • identification of the work you say was copied;
  • the address of the page or file on our site;
  • your name, postal address, telephone number and email address;
  • a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
  • a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act for the owner;
  • your physical or electronic signature.

We remove or disable material that is properly reported, and we may terminate the accounts of people who infringe repeatedly. If your content was removed and you believe that was a mistake, write to the same address and tell us why.

13.Feedback

If you send us a suggestion for the product, we may use it without owing you payment or credit, and without any obligation to keep it confidential. Please do not send us anything you consider confidential. This does not apply to corrections about a park, which are exactly what we want and which we treat as described in the Privacy Policy.

14.Third-party services and links

We link to park authorities, mapping services, weather sources and other sites, and we rely on third-party providers to run the service. We do not control them, we do not endorse everything on them, and we are not responsible for their content, their availability or their practices. Their own terms and privacy policies govern your use of them.

15.Paid features

Aethrio is free to use. There are no paid plans, subscriptions or purchases today. If we introduce them, we will publish the price and the payment terms before anything can be bought, and we will never charge an existing account without your express agreement to that charge.

16.Ending it

  • You may stop using Aethrio at any time, delete your content, and ask us to delete your account by emailing hey@aethrio.co.
  • We may suspend or end your access if you break these terms, if we are required to by law, or if we stop operating the site.
  • Some sections survive the end of this agreement, because they would be meaningless otherwise: the licence for content still published, the disclaimers, the limit of liability, indemnity, and governing law.

17.Disclaimer of warranties

The site and everything in it are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we make no warranty that the information here is accurate, complete, current or suitable for your purpose, or that the site will be uninterrupted, secure or error-free.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits a right you have that cannot be limited by agreement.

18.Limit of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, nor for lost profits, lost data or lost goodwill, nor for personal injury or property damage, arising out of your use of the site, your reliance on anything in it, your visit to any place listed, or any gathering, whether the claim is in contract, tort or anything else, and even if we were told such damage was possible.

Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, which today is zero because the service is free, and one hundred United States dollars.

Where the law does not allow a limitation like this, it applies to the maximum extent it does allow.

19.Indemnity

You agree to indemnify and hold harmless Val Aristides and Aethrio from any claim, loss, damage or reasonable legal cost arising from the content you post, your use of the site, your breach of these terms, or your violation of the law or of anyone else's rights.

20.Disputes, governing law and venue

Talk to us first

If you have a problem, email hey@aethrio.co and describe it. We both agree to try in good faith to resolve it for 60 days before either of us files anything. Nearly everything ends here, and it is far cheaper for both of us than the alternative.

If that does not work

These terms are governed by the law of the State of New York, without regard to its conflict-of-laws rules. Any dispute that the informal step does not resolve will be brought exclusively in the state or federal courts located in New York, and we each consent to their jurisdiction.

If you are a consumer, none of this takes away your right to bring a claim in a small claims court, or any protection your local law gives you that cannot be waived by agreement.

21.Changes to these terms

We may update these terms. The date at the top changes when we do, and we will say so on the site when the change is significant. Continuing to use the site after a change means you accept the updated terms. If you do not accept them, stop using the site and ask us to delete your account.

22.General

  • If any part of these terms is held unenforceable, the rest stays in force and that part is narrowed only as far as necessary.
  • If we do not enforce something straight away, we have not given up the right to enforce it later.
  • We may transfer this agreement if the service is sold or reorganised. You may not transfer it without our consent.
  • These terms, with the Privacy Policy, are the whole agreement between us about the service, and replace anything said earlier.
  • Nobody other than you and us has rights under this agreement.
  • Section headings are for reading convenience and do not affect the meaning.
